Description
According to the State of NJ Judiciary website, "the Municipal Courts in New Jersey are considered courts of limited jurisdiction, having responsibility for motor vehicle and parking tickets, minor criminal-type offenses, municipal ordinance offenses, and other offenses. A Municipal Court usually has jurisdiction only over cases that occur within the boundaries of its municipality.
"Serious criminal cases, such as robbery, auto theft, or assault, may start out as complaints filed in the Municipal Court but are transferred to the Superior Court located at the county courthouse."
About the Municipal Court
Municipal Courts are statutory courts of limited jurisdiction and have responsibility for hearing motor vehicle traffic violations, disorderly and petty disorderly criminal offenses, municipal ordinance violations, certain penalty enforcement codes, health code violations, fish and game, weights and measures, and all other proceedings within the territorial jurisdiction of the municipality.
The New Jersey Court Rules govern the practice and procedures in all municipal courts.
In Hudson County, all indictable offenses are initially heard in Central Judicial Processing Court (CJP), which is located in the Administration Building, 595 Newark Avenue, Jersey City, NJ. At CJP, the County Prosecutor determines if the indictable offense will be heard in the Superior Court, or if the matter will be downgraded to a disorderly persons offense and returned to the municipal court for disposition.
